2em;">“法官，这个账户对我们很重要，能不能先解除冻结，让公司参与投标？”该公司负责人告诉承办人，公司正在进行一项重大工程的投标，而被冻结的银行账户系专门用于工程招投标账户。</span></p><p style="margin-bottom: 15px;text-align: justify;line-height: 2em;"><span style="font-size: 15px;line-height: 2em;">电话中，被执行企业负责人焦急万分。后经承办人了解，实际情况正如该企业负责人所说，该账户被冻结导致该公司无法参与一切投标活动，且对该公司很重要的一项投标活动日期逐渐临近。为此，承办人在保障申请人合法权益的情况下，充分考虑被执行企业生产经营现实，果断摒弃“机械执法”，上线“温度执法”，引导被执行公司采用其他资产作为担保置换。</span></p><p style="margin-bottom: 15px;text-align: justify;line-height: 2em;"><span style="font-size: 15px;line-height: 2em;">被执行公司缴纳197万元的担保金担保置换对其账户的冻结，承办人依法第一时间解除了银行账户的冻结，保障了该公司能够进行正常的投标活动。</span></p><p style="margin-bottom: 15px;text-align: justify;line-height: 2em;"><span style="font-size: 15px;line-height: 2em;">此时，双方企业依然处于相互“怄气”、相互“掣肘”的僵持状态，申请人拒绝与被执行公司和解，多次要求继续冻结其银行账户。</span></p><p
