7月23日，在国新办“高质量完成‘十四五’规划”系列主题新闻发布会上，公安部交通管理局局长王强表示，目前我国市场上销售的汽车搭载的“智驾”系统都不具备“自动驾驶”功能。这些“智驾”系统都还暂时停留在辅助驾驶阶段，也就是说是由系统辅助驾驶人来去执行一些动态驾驶的任务，车辆还是需要人来操控，驾驶人才是最终的责任主体。“如果驾驶人在驾驶车辆的时候‘脱手脱眼’，也就是我们说的双手脱把，两眼不是观察前方，而是低头看手机，甚至是睡觉打盹，不仅存在严重的交通安全风险，一旦出事，还可能面临着民事赔偿、行政处罚和刑事追责三重法律风险。”王强说。发布会介绍，为进一步加强规范管理，公安机关将会同有关部门从加强车企管理、加强法律配套、加强宣传提示三方面开展工作。在加强车企管理方面，公安机关积极配合工业和信息化部等行业主管部门，督促车企落实主体责任，充分开展组合驾驶辅助测试验证，明确系统功能的边界和安全响应措施，严格遵守《中华人民共和国广告法》，杜绝进行夸大和虚假宣传；督促车企严格履行告知义务，强化新用户培训，帮助新用户熟悉掌握汽车辅助驾驶功能的使用方法和禁止事项，切实担负起生产一致性和质量安全的主体责任。在加强法律配套方面，公安机关会同相关部门推动细化《中华人民共和国道路交通安全法》及配套法规规章，明确0到2级辅助驾驶系统“人机共驾”的法律属性，同时推动智能网联汽车生产企业不断提升辅助驾驶系统技术可靠性，制定相关的安全技术标准，并探索将自动驾驶分级标准、辅助驾驶的操作规范纳入到驾驶人教育培训和考试范围。“在使用的过程中，应该清楚认知辅助驾驶的技术边界，一旦我们‘脱手脱眼’，可能面临严重交通安全隐患和法律风险。”王强表示，希望通过采取多种形式的宣传提示，使广大驾驶人清楚认识到现阶段辅助驾驶不等于自动驾驶，在购车和使用的时候，都应该全面了解、掌握辅助驾驶系统的功能特性以及启动和关闭的方法。</section><section
