16px;">某日，王大爷准备带其孙子去屠大叔卫生室看病，因卫生室没开门，王大爷便前往屠大叔家中寻找，当行至屠大叔家门口时，便喊：“家有人呗”，随后一黄一灰两只狗先后吠叫着从屠大叔家中冲出并扑向王大爷，王大爷一边后退躲避一边用手提包撵狗，后退躲避过程中王大爷摔倒在地受伤。该起事故造成王大爷头部外伤、T12压缩骨折、创伤性耳聋等损伤。</span></span></p><p 16px;">《中华人民共和国民法典》第一千二百四十五条规定：饲养的动物造成他人损害的，动物饲养人或者管理人应当承担侵权责任；但是，能够证明损害是因被侵权人故意或者重大过失造成的，可以不承担或者减轻责任。饲养动物损害责任原则上适用无过错责任原则，例外适用过错推定责任原则，即只要饲养的动物造成他人损害，且动物饲养人或管理人不能证明被侵权人存在故意或重大过失的免责事由，无论动物饲养人或管理人有无过错均应承担侵权责任。本案中，屠大叔作为黄狗的饲养人、灰狗的管理人，在不能证明免责事由的情况下</span>，应当承担侵权责任。</span></span></p><p 16px;">当前，农村居民饲养的犬只主要用于看家护院、保护家庭财产。饲养人管理人常因“自家狗不咬人”“追人时主人一喊就回来”等认知误区，忽视动物攻击本能，导致不拴绳等行为普遍存在。部分饲养人管理人以“尊重天性”为由放任犬只户外自由活动，致使犬只随意窜扰、犬群聚集，严重威胁路人安全，甚至引发邻里矛盾。现实生活中，饲养动物致人损害并不限于接触行为造成扑倒、咬伤，还包括吠叫恐吓、追逐驱赶、突然蹿跳等无接触的攻击行为。因此，只要存在动物加害行为、损害后果及两者之间因果关系成立，饲养人管理人未按照规定饲养、管束犬只，应依法承担法律责任。</span></span></p><p
