leaf="">2024年4月，交警部门出具《道路交通事故书认定书》，认定熊某醉酒后未按照驾驶证载明的准驾车型在道路上行驶时未确保安全是造成此次事故的主要原因，承担事故主要责任；易某将车辆违规停放在道路上是造成此事故的次要原因，承担事故的次要责任。熊某受伤后在医院住院治疗，经鉴定，熊某构成十级伤残。经查，易某车辆在某保险公司投保了交强险和100万元商业三责险。</span></span></p><p normal;">本案系机动车交通事故责任纠纷，事故各方应按照交警部门认定的责任各自承担其相应责任。本案中熊某负主要责任（70%），易某负次要责任（30%）。</span>熊某因交通事故造成的各项损失合计为226642.87元。<span textstyle="" style="color: rgb(0, 122, 170);font-weight: bold;">机动车发生道路交通事故造成人身伤亡、财产损失的，先由保险公司在交强险限额内予以赔偿，超过部分，由承保三责险的保险公司承担赔偿责任，仍然不足或者没有投保机动车商业保险的，由侵权人赔偿。</span></span></span></p><p style="margin-top: 15px;display: block;line-height: 1.75em;text-indent: bold;">根据《机动车交通事故责任强制保险条例》的规定，交强险实行的是无过错责任原则。</span>无论被保险人在交通事故中是否有责任，交强险赔付在交强险赔偿限额内均全额赔付，只区分有责赔付（医疗费1.8万元、伤残赔偿18万元、财产损失2000元）和无责赔付（医疗费1800元、伤残赔偿1.8万元、财产损失100元），并不以事故责任比例进行赔付。<span textstyle="" style="color: rgb(0, 122, 170);font-weight: bold;">其中全责、主责、同等、次责均为有责赔付，无责为无责赔付。</span>本案中易某有责任，故某保险公司应在交强险限额内赔付原告损失198875.93元。对于超出交强险赔偿限额的部分，需要根据事故责任的划分由当事人按照比例承担，因此某保险公司在商业三责险内应再赔付熊某损失8330.08元（（226642.87-198875.93）×30%），某保险公司在交强险和商业三责险内赔付熊某共计207206.01元。</span></span></p></section></section></section><p bold;">交通事故责任的认定，主要依据违法行为对事故发生所起的作用及过错严重程度。</span>违停属于交通违法行为，即便驾驶人未实际驾驶车辆，但若停车行为妨碍他人正常通行，主观上便存在过错，一定程度上可能导致事故发生。所以，<span textstyle="" style="color: rgb(0, 122, 170);font-weight:
