男子因诈骗罪服刑，期间又诈骗多名狱友

<br/>红星新闻梳理公开司法文书发现，从2007年开始，李某先后因抢劫罪、盗窃罪、诈骗罪等罪名入狱服刑。李某最后一次入狱服刑是2020年12月4日，罪名是诈骗罪，被判处有期徒刑6年6个月。但这次刑期尚未服刑完毕，李某就因在监狱内对同监区狱友进行诈骗，被甘肃省酒泉监狱立案侦查并隔离审查。</span></p><p style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"> <br/>据公诉机关指控，2023年3月8日，服刑人员吴某到酒泉监狱服刑，与李某关押于同一监室。李某利用自己担任分监区生活委员和纪律委员的机会，在与吴某接触过程中谎称可以调整轻松劳动岗位、照顾生活，取得吴某信任。吴某通过拨打亲情电话，以及利用外协人员熊某捎带纸条传递信息的方式，告知家人向李某提供的其父亲李某2名下银行账户转账。一周后，吴某亲属向李某2银行账户转账10万元。后李某又以可让吴某在狱内过得轻松一点，可以为其办理假释为由，要求吴某再次转账60000元，吴某因家庭原因未支付。</span></p><p style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"> <br/>被骗的除了吴某，还有同监区的另外几名狱友。根据公诉机关指控，2023年春节后的一天，李某跟狱友梁某聊天得知梁某在狱内香烟等生活物资不够，谎称自己可以向其提供香烟及其他货物，梁某相信了，通过拨打亲情电话的方式，通知家人往李某提供其父李某2银行账户转入4000元。</span></p><p style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"> <br/>2023年3月，李某以可为狱友董某违规从监狱外捎带进来高档香烟及生活用品为由，取得董某信任，采取拨打亲情电话、利用外协人员熊某捎带纸条给其父亲李某2传递信息，再通过李某2联系董某亲属转账。2023年6月6日，董某家属转账3800元到李某2名下银行账户。</span></p><p style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"><br/> <br/>此外，2023年3月的一个晚上，李某以可为狱友肖某提供生活关照、安排轻松劳动岗位为由，取得肖某的信任，采用拨打亲情电话、利用外协人员熊某捎带纸条给其父亲李某2传递信息，再让李某2联系肖某亲属转款。2023年6月6日，肖某家属给李某2银行账户转账5000元。</span></p><p style="margin: 0px;line-height: 1.75em;"><span 8px;line-height: 1.75em;"><span style="font-size: 16px;">公诉机关指控，李某多次骗取同监区服刑的吴某、梁某、董某、肖某钱款共计172800元，其中60000元未遂，112800元全部以银行转账方式打入其父亲李某2银行账户。</span></section><section style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"> <br/>案发后，李某2向酒泉监狱退缴赃款45000元，案涉人员熊某退缴8500元，合计退缴53500元，其余未退缴。</span></section><section style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"> <br/>甘肃省酒泉市肃州区人民法院审理认为，李某以非法占有为目的，虚构事实骗取他人财物，数额巨大，其行为已触犯刑律，构成诈骗罪，控方指控的犯罪事实清楚，证据确实、充分，指控罪名成立。指控的诈骗金额为172800元，其中60000元系犯罪未遂，犯罪既遂金额为112800元。李某到案后能如实供述犯罪事实，有坦白情节，并自愿认罪认罚，案发后其亲属退赔被害人部分损失，依法应从轻处罚；有前科劣迹，可酌定从重处罚；被告人在前罪刑罚执行完毕以前，又犯新罪，应对新罪与前罪进行并罚。对于辩护人所提被告人愿意继续退赃的辩护观点，经查，李某在监狱服刑，自己并无能力退赃，其亲属已将所获赃款挥霍，至今并未继续退缴，该辩护观点不予采纳。</span></section><section style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"> <br/>最终，法院判李某犯诈骗罪，判处有期徒刑3年5个月，并处罚金30000元，与前罪犯诈骗罪余刑2年10个月，罚金100000元并罚，合并执行有期徒刑6年，并处罚金130000元。此外，已退缴的53500元，按比例发还被害人，剩余59300元继续予以追缴。</span></section></p><p style="display: none;"><mp-style-type
