line-height: 30px; color: rgb(34, 34, 34); margin-top: 0px !important; margin-bottom: 0px !important; padding: 0px !important;"><span style="max-width: 100%; color: rgb(0, 0, 0);">南关法院认为，被告人大海与小娟相约自杀，其陪同小娟购买胰岛素、注射针管等物品，明确希望并放任小娟死亡，其在小娟死亡过程中，有救助义务却始终没有救助，系不作为的故意杀人，其行为已构成故意杀人罪。鉴于被告人大海的犯罪行为社会危害性相对较小，主观恶意和人身危险性相对较轻，应当认定为情节较轻。鉴于被告人大海明知他人报警在现场等待，系自首，可依法从轻处罚。最终，南关区法院判大海犯合同诈骗罪，判处有期徒刑11年，并处罚金人民币20万元；犯故意杀人罪，判处有期徒刑5年，决定执行有期徒刑15年，并处罚金人民币20万元。同时判处大海退赔7名被害人共计260余万元。</span></p><p style="max-width: 100%;
