65);">答:</span></strong>我国已建立基本养老保险、基本医疗保险、工伤保险、失业保险、生育保险等社会保险制度。根据《中华人民共和国社会保险法》《中华人民共和国劳动法》等相关法律规定,用人单位和劳动者必须依法参保并缴纳社保费,用人单位无权同意劳动者不参加社保。据此,即便劳动者是自愿放弃参加社保,并与用人单位签订其不参加社保的协议,因违反法律强制性规定而应认定无效。故如劳动者以用人单位未依法为其参加生育保险或者缴纳生育保险费,导致其无法享受生育保险待遇为由,起诉到法院请求用人单位赔偿生育医疗费损失的,在社会保险行政部门不能补办或补付且该损失已经核定的情况下,人民法院应予支持。</p></section></section></section></section><section
