丰县人民陪审员选任公告
<p data-mpa-powered-by="yiban.io"><span style="font-size: 16px;letter-spacing: 0.034em;">为进一步推进司法民主，完善人民陪审员制度，扎实做好人民陪审员选任工作，根据《中华人民共和国人民陪审员法》《人民陪审员选任办法》等规定，现将2023年丰县人民陪审员选任有关事项公告如下：</span></p><p><strong><span style="font-size: 16px;">一、选任名额</span></strong><o:p></o:p></p><p><span style="font-size: 16px;">根据工作实际，本次选任150名人民陪审员。</span><o:p></o:p></p><p><strong><span style="font-size: 16px;">二、选任条件</span></strong><o:p></o:p></p><p><span style="font-size: 16px;">（一）担任人民陪审员应当具备下列条件：</span><o:p></o:p></p><p><span style="font-size: 16px;">1.拥护中华人民共和国宪法；</span><o:p></o:p></p><p><span style="font-size: 16px;">2.年满二十八周岁；</span><o:p></o:p></p><p><span style="font-size: 16px;">3.遵纪守法、品行良好、公道正派；</span><o:p></o:p></p><p><span style="font-size: 16px;">4.具有正常履行职责的身体条件；</span><o:p></o:p></p><p><span style="font-size: 16px;">5.担任人民陪审员，一般应当具有高中以上文化程度。</span><o:p></o:p></p><p><span style="font-size: 16px;">（二）下列人员不能担任人民陪审员：</span><o:p></o:p></p><p><span style="font-size: 16px;">1.人民代表大会常务委员会的组成人员，监察委员会、人民法院、人民检察院、公安机关、国家安全机关、司法行政机关的工作人员；</span><o:p></o:p></p><p><span style="font-size: 16px;">2.律师、公证员、仲裁员、基层法律服务工作者；</span><o:p></o:p></p><p><span style="font-size: 16px;">3.其他因职务原因不适宜担任人民陪审员的人员。</span><o:p></o:p></p><p><span style="font-size: 16px;">（三）有下列情形之一的，不得担任人民陪审员：</span><o:p></o:p></p><p><span style="font-size: 16px;">1.受过刑事处罚的；</span><o:p></o:p></p><p><span style="font-size: 16px;">2.被开除公职的；</span><o:p></o:p></p><p><span style="font-size: 16px;">3.被吊销律师、公证员执业证书的；</span><o:p></o:p></p><p><span style="font-size: 16px;">4.被纳入失信被执行人名单的；</span><o:p></o:p></p><p><span style="font-size: 16px;">5.因受惩戒被免除人民陪审员职务的；</span><o:p></o:p></p><p><span style="font-size: 16px;">6.其他有严重违法违纪行为，可能影响司法公信的。</span><o:p></o:p></p><p><span style="font-size: 16px;">（四）人民陪审员的任期为五年，一般不得连任。</span><o:p></o:p></p><p><span style="font-size: 16px;">公民担任人民陪审员不得超过两次。公民不得同时在两个以上的基层人民法院担任人民陪审员。</span><o:p></o:p></p><p><span style="font-size: 16px;">人民监督员不得担任人民陪审员。</span><o:p></o:p></p><p><strong><span style="font-size: 16px;">三、选任程序</span></strong><o:p></o:p></p><p><span style="font-size: 16px;">（一）发布公告</span><o:p></o:p></p><p><span style="font-size: 16px;">公告期为30日。人民陪审员选任工作自发布公告之日起通过随机抽选、个人申请和组织推荐相结合的方式进行选任。</span><o:p></o:p></p><p><span style="font-size: 16px;">（二）选任方式</span><o:p></o:p></p><p><span style="font-size: 16px;">1.随机抽选：丰县司法局会同丰县人民法院、丰县公安局，从辖区内年满二十八周岁的常住居民名单中，随机抽选拟任命人民陪审员五倍以上的人员作为人民陪审员候选人，对人民陪审员候选人进行资格审查，征求候选人意见。</span><o:p></o:p></p><p><span style="font-size: 16px;">2.个人申请：符合担任人民陪审员条件的公民，向丰县司法局提出书面申请，提交身份、学历证明等书面材料，并填写《人民陪审员候选人申请表》。</span><o:p></o:p></p><p><span style="font-size: 16px;">3.组织推荐：公民所在单位、户籍所在地或经常居住地的基层群众自治性组织、人民团体征得本人同意后进行推荐，提交被推荐人身份、学历证明等书面材料，并填写《人民陪审员候选人推荐表》。</span><o:p></o:p></p><p><span style="font-size: 16px;">通过个人申请和组织推荐产生的人民陪审员，不超过人民陪审员名额数的五分之一，本次不超过30人。</span><o:p></o:p></p><p><span style="font-size: 16px;">（三）资格审查及征求意见</span><o:p></o:p></p><p><span style="font-size: 16px;">丰县司法局会同丰县人民法院、丰县公安局依照《人民陪审员法》和《人民陪审员选任办法》相关规定，对人民陪审员候选人、人民陪审员申请人和被推荐人进行资格审查，并征求其对担任人民陪审员的意见。</span><o:p></o:p></p><p><span style="font-size: 16px;">（四）确定并公示拟任命人选</span><o:p></o:p></p><p><span style="font-size: 16px;">1.丰县司法局会同丰县人民法院，从通过资格审查并同意担任人民陪审员的候选人名单中随机抽选确定拟任命人选。</span><o:p></o:p></p><p><span style="font-size: 16px;">2.丰县司法局会同丰县人民法院，从通过资格审查的人民陪审员申请人和被推荐人中确定拟任命人选。个人申请和组织推荐人数超过拟选任人数的，在通过的人员中随机抽选确定拟任命人选。</span><o:p></o:p></p><p><span style="font-size: 16px;">3.丰县司法局会同丰县人民法院、丰县公安局向社会公示拟任命人民陪审员名单。公示期不少于五个工作日。</span><o:p></o:p></p><p><span style="font-size: 16px;">（五）提请任命</span><o:p></o:p></p><p><span style="font-size: 16px;">经公示后确定的人民陪审员人选，由丰县人民法院院长提请丰县人大常委会任命，任期五年。</span><o:p></o:p></p><p><span style="font-size: 16px;">（六）公告通知</span><o:p></o:p></p><p><span style="font-size:
