0);"><strong>二审法院认为,</strong></span>关于涉案房产归属应结合购房出资情况予以认定。首先,上诉人李某主张首付款是其母亲汇款支付,被上诉人孙某虽然对此有异议但未提交孙某支付首付款的证据,可以认定购房首付款由李某母亲支付。其次,上诉人李某主张剩余房款由其使用个人住房公积金贷款支付,在一审中被上诉人孙某亦对此表示认可。一审法院仅查明房产合同签订的时间以及支付房款首付款的时间早于上诉人与被上诉人登记结婚的时间,但未查明房款的实际付款情况,就认定该房产系孙某婚前个人购买属于孙某婚前个人财产,属于认定事实不清,本院予以纠正。</p><p style="white-space: normal;"> 在子女结婚前购房的,除非父母明确表示赠与双方,否则父母的出资就是对自己子女的单独赠与。本案中,李某母亲支付的购房首付款应视为对李某个人的赠与。李某婚后偿还房贷的部分,应视为夫妻共同财产,可以结合房屋升值情况予以分配。鉴于本案涉案房产首付款以及贷款偿还情况,认定涉案房产归李某所有,剩余房贷由李某自己偿还。<strong><span 近年来,随着房地产价格的不断攀升,在离婚案件中,房屋性质的认定和分割已经成为一个难点。由于房屋价格较高,子女在结婚时往往无力负担,因此购买婚房的资金来源日趋复杂化,可能既包括了婚前一方父母或双方父母的出资,也包括了婚后夫妻双方的出资,即返还按揭贷款或公积金贷款等。在权属方面,婚房有的登记在夫妻双方的名下,有的则仅仅登记在一方的名下。由于购房时相关当事人关系融洽,因此对于房屋的权属并没有明确的约定,自然更不可能订立书面合同;一旦夫妻关系破裂,准备离婚,双方又对房屋的权属各执一词,给此类案件的审理带来很大的难度。<br/></p><p style="white-space: normal;"> 具体来说,关于父母出资的性质,如果有明确约定是赠与还是借款,要遵从约定。如果属于赠与,根据购房时间的不同,父母出资所赠与的对象就有所差异。通常情况下,在子女结婚前购房的,除非父母明确表示赠与双方,否则父母的出资就是对自己子女的单独赠与;在子女结婚后购房的,除非父母明确表示赠与一方,否则父母的出资就是对子女夫妻双方的赠与。结合本案,李某的母亲出资支付了房屋的首付款,支付时间早于李某登记结婚之前,李某与其母亲之间也没有明确约定该款项属于借款,因此,可以推定李某母亲的出资是对李某个人的赠与。在分割房产时,李某母亲的出资就依法属于李某个人。对于婚后夫妻双方的出资和共同偿还银行贷款,都应认定为夫妻共同财产。因此,本案中,夫妻关系存续期间李某偿还的住房公积金贷款和利息按照夫妻共同财产予以分割。对于判决离婚后剩余的房贷,一般情况是房产判给谁就由谁来负担。</p></section></section></section></section></section></section><section
