data-mpa-powered-by="yiban.io">根据《中华人民共和国企业破产法》、《最高人民法院关于审理企业破产案件指定管理人的规定》、《徐州中级人民法院关于规范破产管理人选任和管理工作的意见（试行）》等规定，我院对徐州美韵来商贸有限公司、徐州初阳机械设备有限公司、徐州金都物流有限公司、徐州飞腾纺织有限公司、徐州鲜之源食品有限公司、徐州宝彭车业有限公司、徐州市凤元祥商贸有限公司、徐州途友服饰有限公司、丰县同仁居大酒店有限公司、丰县新丰农业生产资料有限公司、江苏梦昊然服装科技有限公司等11家企业破产清算案件公开选任管理人，拟采用“随机方式”选任管理人，邀请中介机构积极报名参与。现就相关事项公告如下：</section><section 一、申报条件（同时具备）1．本次申报机构应为在册（在徐州市中级人民法院破产管理人名册内）的律师事务所、会计师事务所、企业破产清算有限公司，可以由三家以内的律师事务所等组成管理人中介机构团队联合申报，也可以单独申报；2．申报单位及其团队成员近三年未因执业、经营中的故意或重大过失等行为受到行政机关、监管机构或者行业自律组织行政处罚或纪律处分；3．申报机构及其团队成员与债务人及其关联公司不存在《中华人民共和国企业破产法》第二十四条及《最高人民法院关于审理企业破产案件指定管理人的规定》第九条、第二十三条、第二十四条规定的不得担任管理人的情形。 二、申报流程1．有意向的机构向本院提交申报书；2．根据申报名单和破产案件需要采用摇号等随机方式，最终确定选任管理人。 三、申报要求申报机构应于申报期限届满前向本院提交申报书及与申报书内容相对应的证件、资料。申报书应包括并不限于以下内容：1．申报机构工作经验和竞争优势：包括担任管理人的已结和在办案件清单（注明独立履职还是协助参与，是全程参与还是部分参与），并附相应的法律文书；破产重整、和解等典型案件具体履职情况及体现勤勉尽责义务的做法）；2．申报机构的基本情况（注明管理人等级）、从事破产工作团队建设情况；3．授权委托书：载明负责人、联络人、团队人员及联系方式；4．获选后的工作思路，包括组织架构、职责分工、主要工作预案等；5．清算组报酬的报价方案；6．申报人认为自身优势的其他内容。注：所有申报材料装订成册（包含上述申报内容及佐证材料、授权委托书、联络人及联络方式等），并编制目录，一式两份提交本院。申报机构应按照要求递交申报材料，递交不符合要求的视为未递交申报材料。
