借条是借贷纠纷中至关重要的证据，也是表明债权债务关系的书面凭证。<span style="color: rgb(122, 68, 66);"><strong>男女恋爱期间，一方写下巨额欠条以证明真心，算不算借款？分手后要不要还？</strong></span>近日，重庆市江津区人民法院审结一起民间借贷纠纷案，原告施先生与被告陈女士因恋爱期间写下的一张10万元借条引发诉讼。</p><p style="white-space: normal;"> 施先生是一名已婚中年男士，在某相亲平台隐瞒其已婚事实，以“离异、单身”身份注册后，在该平台与陈女士相识并发展成恋人关系。恋爱期间，施先生多次向陈女士微信转账，陈女士也曾多次从重庆飞往广州看望并照顾施先生。</p><p style="white-space: normal;"> 据陈女士陈述，2022年4月中旬，其因急需1万元向施先生提出借款。在写欠条时，施先生提出让陈女士将欠条金额写成10万元，表示这样才能证明陈女士对他是真心的，不会离开他。</p><p style="white-space: normal;"> 出于对这段感情的重视，希望以后能和施先生长久相处，陈女士便听从要求在欠条上将借款金额“壹万元整”划掉，改为“拾万元整”，并写明“如以后分手，将如数归还”。借条出具的当日，施先生向陈女士转账1万元。</p><p style="white-space: normal;"> 据转账记录显示，两人恋爱期间，施先生共向陈女士转款11.8万元，其中包含131.4元、520元等特殊含义金额，也包含166.69元、188.88元、500元等不等的金额。而后，陈女士无意间得知施先生竟是已婚人士，便要求分手。</p><p style="white-space: normal;"> 2023年2月，施先生及其妻子周女士拿着10万元借条将陈女士起诉至江津区法院，要求其归还欠款11.8万元。</p><p style="white-space: normal;"> 法院审理后认为，施先生刻意隐瞒其已婚身份在交友网站与被告陈女士相识、恋爱、同居，其向陈女士转账的次数、金额，不符合民间借贷的通常交易方式。同时，该期间陈女士也曾向施先生转账，并为其购买药品、衣服等，足以认定该款项为二人恋爱、同居期间的往返机票、日常生活开支的费用及部分赠与。</p><p style="white-space: normal;"> 结合双方转账金额、借条涂改痕迹以及双方陈述，法院综合认定双方借款为1万元，判决陈女士返还原告施先生、周女士借款1万元及逾期利息。</p><p style="white-space: normal;"> <strong><span style="color: rgb(122, 68,
