margin-bottom: 20px; padding: 0px; overflow-y: auto; max-width: 100%; line-height: 30px; box-sizing: border-box; border: 0px; text-align: justify; text-indent: 2em;">北京市盈科（西安）律师事务所高级合伙人律师王毅说，根据我国《农村土地承包法》第17条规定，承包方依法享有承包地的使用、收益的权利，有权组织生产经营和处置产品。农户为销售自家农产品做广告是经营销售的方式之一，有权在法律规定范围内在承包土地上进行广告宣传的经营活动。根据《城市管理执行办法》第8条，城市管理执法的行政处罚权范围包括住房城乡建设领域法律法规规章规定的行政处罚权，以及环境保护管理、工商管理、交通管理、水务管理、食品药品监管方面与城市管理相关部分的行政处罚权。本次事件中，如视频和地图位置所示，农户广告宣传标语若位于田间距离道路保持合理距离，没有影响到来往车辆行人的安全，也没有影响市容，城管无权限要求其拆除整治，侵犯了农民的合法生产经营自主权。</p><p data-track="36" style="margin-top: 20px; margin-bottom: 20px; padding: 0px; overflow-y: auto; max-width: 100%; line-height: 30px; box-sizing: border-box; border: 0px; text-align: justify; text-indent: 2em;">王毅说，另外，根据《行政处罚法》第52条规定：“执法人员当场作出行政处罚决定的，应当向当事人出示执法证件，填写预定格式、编有号码的行政处罚决定书，并当场交付当事人。当事人拒绝签收的，应当在行政处罚决定书上注明。”本次事件中，城管强行撕毁农户广告旗、条幅，属于未经合法程序，擅自拆除、破坏公民的私人财物的，可能构成违规执法。</p><p data-track="37" style="margin-top: 20px;
