村民私搭浮桥为何是“寻衅滋事”？办案民警回应

16px;">近日，吉林省白城洮南市瓦房镇振林村村民私自建桥被判刑的消息引发社会各界的关注。村民黄德义组织家人在洮儿河上建桥收费。2018年，当地水利局以非法建桥为由处罚并强制黄德义拆除浮桥。2019年，黄德义以寻衅滋事罪被洮南市法院一审判处有期徒刑两年，缓刑两年，其他17人也分别被判刑。此前，洮南市有关方面在接受央广网采访时，就黄德义修桥一事的合法性、水利部门的调查结果和村民过河之困等问题予以回应。</span></section><section style="font-size: 16px;">“举报人说，黄德义先是于2005年搭简易浮桥，2014年后将桥体不断扩建加固，变成固定桥，他的家族成员不断进入，在桥头拉上铁链和绳索，给钱才放行，明显是占用公共资源谋取利益。”该民警说。</span></section><section style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"><br/>由于办案时桥已拆除，警方只能从走访中获得线索。警方通过水利部门获悉，黄德义搭建浮桥的河段每年丰水期不足5个月，其余时间河水很浅甚至干涸。“而我们从村民处了解到，黄德义等人将河道上原有的可以通行的小道堵死，把河床挖坏，因此即使河水很浅，只要车辆开上去就得陷进去，就只能从他的桥上通过。”该民警说。 16px;">据洮儿河流域卫星图显示，图片中间的一条凸起条带就是黄德义的桥。图片拍摄月份不详，但通过图中实景可以看出，河道两岸植被茂密，很可能为夏季，河水并不丰沛。据警方了解，黄德义的桥常年存在，家族成员24小时排班收费，而非他所说的“只在丰水期才建”。“黄德义还特意为了收费建了个彩钢房，并安装了个地秤，给过往大车称重收费。”该民警说，图片上左侧桥头旁的蓝色部分就是黄德义等用于收费的彩钢房。</span></section><section 16px;"><strong><br/></strong>对于黄德义质疑的总收费52950元的问题，该民警说，因为办案时浮桥已拆，且当时过桥的大部分为过路车辆，流动性大，给办案增加了很大难度。“我们受理案件之后，去附近村庄征集线索，让村民主动来提供线索。”该民警说。</span></section><section style="margin: 0px 8px;line-height: 16px;"><br/>举报人还向警方提供线索，黄德义在河道两岸开荒种地，为此，还和河对岸的洮北区平安镇安全村发生过冲突。记者了解到，2017年5月10日晚，黄德义带人与安全村村委发生肢体冲突，安全村党支部书记谷天福左耳受伤。记者通过法律文书网查询，2022年，黄德义与安全村因为土地承包一事发生过民事诉讼。</span></section><section style="margin: 0px 8px;line-height: 1.75em;"><span style="font-size: 16px;"><br/>就上述情况，记者联系了黄德义。黄德义说，举报人李某与自家有嫌隙，所以为“恶意举报”。“破坏河道的事绝对没有！搭桥也不存在强行收费，为什么我们家人要24小时排班守桥？因为这桥是我们搭建的，我们需要为它的安全负责任，所以派人看守。”记者问及既无强制收费，为何要拉绳索？“因为这桥不宽，是单行，我们得拦一下，帮过往车辆看看对面有没有来车。”黄德义说，和安全村村委的冲突确有其事，但是谷天福的伤不是自己打的，是谷天福摔倒所致。</span></section><section
