style="white-space: normal;"> 2021年3月11日，谭晓晓的父亲谭伟余去学校接女儿放学时，<span style="color: rgb(255, 169, 0);"><strong>临时受黎晓雨奶奶的委托，顺便将黎晓雨接回家。同时，他还受托接女儿的同学廖启晨回家。</strong></span></p><p style="white-space: normal;"> 当日18时左右，因黎晓雨、谭晓晓、廖启晨没有写完作业，谭伟余在班级门口等候。谭伟余边等边低头看手机，没有发现黎晓雨与廖启晨走出了教室。黎晓雨与廖启晨走到校门，保安发现后将廖启晨叫回学校，<strong><span style="color: rgb(255, 169, 0);">黎晓雨则独自出校门离开。</span></strong></p><p style="white-space: normal;"> 等到谭晓晓写完作业，谭伟余从廖启晨口中得知黎晓雨独自离开了学校。谭伟余连忙追了出去，追到路口看到黎晓雨，<strong><span style="color: rgb(255, 169, 0);">但黎晓雨不理会谭伟余的叫喊，坚持走小路回家，并一直向前跑。</span></strong>谭伟余见状赶紧追，但无法追上。谭伟余打电话给妻子，让她转告黎晓雨奶奶从河对面的小路过来接黎晓雨。不料，黎奶奶没能接到孙女。</p><p style="white-space: normal;"> 18时51分，当地派出所接到报案后立即出警到达现场，并与黎晓雨的亲属一同寻找并查看沿途监控。直到20时50分许，<strong><span style="color: rgb(255, 169, 0);">黎晓雨被发现溺亡在村旁的河里。据现场调查取证以及法医对尸体进行检查，排除他杀可能。</span></strong></p><p style="white-space: normal;"> 黎晓雨溺亡后，她的父母受到极大的创伤，认为学校、谭伟余与黎晓雨的死亡有因果联系，于是诉至兴安县人民法院索赔，请求法院判令学校、谭伟余连带赔偿死亡赔偿金、丧葬费、误工费、交通费、精神损害抚慰金等各项经济损失，扣除学校已先行赔付的丧葬费5.5万元，共计需赔偿74万余元。</p><p style="white-space: normal;"> 学校辩称，<strong><span style="color: rgb(255, 169, 0);">黎晓雨不是在学校学习、生活期间受到人身损害的。</span></strong>学校对于黎晓雨的溺水身亡没有过错，依法不应承担侵权赔偿责任。</p><p style="white-space: normal;"> 谭伟余辩称，他去接孩子时，黎晓雨、谭晓晓、廖启晨都在写作业，他的女儿谭晓晓是最后写完的，<strong><span style="color: rgb(255, 169, 0);">他没有办法在同一时间内一次性接完3个小朋友。他没接到黎晓雨，不应该承担责任。</span></strong></p></section></section></section><section style="text-align: left;justify-content: flex-start;display: 兴安县人民法院审理后认为，黎晓雨系无民事行为能力人，其父母作为黎晓雨的法定监护人，对黎晓雨的生命安全负有法定监护责任，正是这种监护责任的缺失，导致黎晓雨不能正确认知独自回家并过河的危险性并拒绝由谭伟余接回家，以致悲剧发生。<strong><span style="color: rgb(255, 169, 0);">黎晓雨溺亡与其父母疏于监管教育具有因果关系，其父母对黎晓雨溺水死亡应该承担主要责任。</span></strong></p><p style="white-space: normal;"> 学校开展课后延时服务系学生家长自愿选择的，且即使学校延时放学，作为学生家长亦会等候至学生放学，故学校开展延时服务、延时放学与此案发生没有因果联系。但由于学校对于接学生放学的管理不统一，造成接生混乱。学校保安也没有严格执行学生出校园由家长带领的规定，放黎晓雨独自出校门。<strong><span style="color: rgb(255, 169, 0);">学校对于黎晓雨独自出校门后溺亡存在管理不当，造成黎晓雨脱离学校及监护人的监管，以致最终造成黎晓雨溺亡的后果，应承担相应的管理责任。</span></strong></p><p style="white-space: normal;"> <strong><span style="color: rgb(255, 169, 0);">谭伟余受黎晓雨奶奶的委托接孩子放学，在受委托期间负有特殊的安全注意义务，应避免黎晓雨遭到不必要的伤害。</span></strong>但是谭伟余在接黎晓雨时没有尽到照看义务，而是低头看手机，没有及时发现黎晓雨离开教室后独自出校门。谭伟余在追黎晓雨到某村路口时，黎晓雨表示要走小路回去。谭伟余已经预见黎晓雨一个人走小路回家必须过河而河床涨水有危险，没有将孩子叫回，错失了挽回悲剧的一次机会，<strong><span style="color: rgb(255, 169, 0);">存在疏忽大意的过失。</span></strong>因此，谭伟余对于黎晓雨的溺水身亡亦负有一定的责任。</p><p style="white-space: normal;"> 综合考虑各方的过错行为及对损害后果的影响程度，兴安县人民法院酌定对于黎晓雨的溺水身亡<strong><span style="color: rgb(255, 169, 0);">由其父母承担60%的责任，学校承担30%的责任，谭伟余承担10%的责任。</span></strong></p><p style="white-space: normal;"> 据此，兴安县人民法院作出一审判决：学校赔偿黎晓雨父母18万余元（已扣除学校支付的5.5万元）；谭伟余赔偿黎晓雨父母7万余元。</p></section></section></section><section style="text-align: left;justify-content: flex-start;display: flex;flex-flow: row “我善意无偿帮接送孩子，完全没有料到会有如此后果，我对黎晓雨的死亡表示惋惜。但我在接送孩子过程中，主观上没有故意或重大过失行为，不应承担民事责任。”谭伟余不服一审判决，向桂林市中级人民法院提起上诉。</p><p style="white-space: normal;"> <span style="color: rgb(0, 0, 0);letter-spacing: 1px;">桂林市中级人民法院</span>审理后认为，谭伟余临时接受委托，在接自家孩子放学时顺便将黎晓雨接回，<strong><span style="color: rgb(255, 169, 0);">属于无偿提供帮工。</span></strong>谭伟余接受委托事务后，应当尽心尽力完成受托的事务，避免黎晓雨受到侵害，在接送过程中应当谨慎小心，尽量降低事故发生的隐患，消除接送过程中可能存在的不安全因素。<strong><span style="color: rgb(255, 169, 0);">但谭伟余在等待时一直低头看手机，未能发现黎晓雨走出教室。</span></strong>谭伟余追到路口看见黎晓雨时，明知此时河床涨水存在危险，却放任黎晓雨自己回家，只是打电话叫黎晓雨奶奶到河边接人。黎晓雨作为年仅7岁的未成年人，缺乏对潜在危险的认知，<strong><span style="color: rgb(255, 169, 0);">谭伟余在接送黎晓雨时更应当尽到特殊的保护注意义务。</span></strong></p><p style="white-space: normal;"> <span style="color: rgb(0, 0, 0);letter-spacing: 1px;">桂林市中级人民法院</span>指出，谭伟余无偿替黎丽诗接送孩子的确属于善意行为，在道德及法律层面值得肯定。但由于谭伟余在事故发生的过程中存在疏忽大意的重大过失，一审法院酌定谭伟余对黎晓雨的死亡承担10%的赔偿责任，并无明显不当。</p><p style="white-space: normal;"> 不久前，<span style="color: rgb(0, 0,
