15px;">原告张某某自建的房屋系两层混合结构房屋(带阁楼),王某某的房屋为一层瓦房,位于张某某房屋的东侧。2021年,王某某考虑自己房屋老旧,不能满足家人生活需要,遂将自家一层房屋拆除并翻建成三层楼房。可王某某的新房建好不久后,张某某发现自己的房屋出现多处开裂、墙皮脱落、墙面渗水等受损情况,无法正常居住。张某某认为是王某某新建房屋导致,在多次与其沟通无果的情况下,将王某某告上法庭。</span></p><p style="line-height: 2em;margin-bottom: 15px;"><span style="font-size: 15px;">审理中,原告张某某申请对涉案房屋裂缝等情况与相邻王某某房屋之间是否存在因果关系进行鉴定。经法院委托,第三方鉴定公司出具鉴定意见为:王某某房屋与张某某房屋紧邻,且王某某在地基开挖时,未采取相关支护措施,基础施工过程中土体扰动以及土体应力释放会对张某某房屋产生影响。二层墙体裂缝主要与相邻建房存在因果关系;其余问题与张某某房屋自身建造、温度收缩变形等及相邻施工均存在因果关系。鉴定工程造价为27万余元,其中涉案房屋拆除金额为2.7万余元,二层、阁楼层及屋面层新建金额为21万余元,一层房屋修复金额为6千余元,二层水电安装金额为1.8万余元。</span></p></section></section><section><section 15px;">《中华人民共和国民法典》第二百九十五条规定:“不动产权利人挖掘土地、建造建筑物、铺设管线以及安装设备等,不得危及相邻不动产的安全。”不动产权利人在处理邻里关系时,应当坚持有利生产、方便生活、团结互助、公平合理的原则。在建造建筑物时,不得危及相邻不动产的安全,否则要承担相应的赔偿责任。本案中,王某某在建房施工时未考虑施工现场是否会对毗邻的建筑物、构筑物造成损害,亦未采取必要的安全防护措施,其因不履行维护相邻不动产安全义务致使相邻不动产遭受损害,最终承担了赔偿责任。</span></p></section></section><section><section
