明确了！这40项交通轻微违法行为免罚

16px;'>新华日报·交汇点记者了解到，近日，江苏省交通运输厅印发《关于在全省交通运输领域推行轻微违法行为依法免予处罚高频事项清单和告知承诺制的意见（试行）》，明确</span><span style='font-size: 16px;color: rgb(61, 170, 214);'><strong>自2022年3月1日起，江苏40项交通运输领域的违法行为轻微并及时改正，没有造成危害后果的，将不予行政处罚。</strong></span></section><section style='line-height: 1.75em;margin-bottom: 15px;margin-left: 8px;margin-right: 8px;'><span style='font-size: 16px;'>本次《省免罚清单》中公布的免罚事项涉及道路运输、水上交通、港口、交通工程建设等领域。如：对在公路及公路用地范围内摆摊设点、堆放物品，影响公路畅通的处罚；对将公路作为试车场地的处罚；对出租汽车经营者不按照规定建立并落实投诉举报制度的处罚；对出租汽车驾驶员不按照规定使用标志牌、标志灯、计价器、IC卡刷卡器以及有关信息化管理设施，不按照规定主动向乘客出具合法有效的票据的处罚等。</span></section><section style='line-height: 1.75em;margin-bottom: 15px;margin-left: 8px;margin-right: 8px;'><span style='font-size: 16px;'>以“对出租汽车经营者不按照规定建立并落实投诉举报制度的处罚”为例，目前依据《巡游出租汽车经营服务管理规定》，将由县级以上地方人民政府出租汽车行政主管部门责令改正，并处以5000元以上10000元以下罚款。构成犯罪的，依法追究刑事责任。这类情况今年3月1日之后可免罚，免罚的前提是同时满足三个条件：一、初次被发现；二、不存在不落实举报投诉的情况，未造成乘客举报投诉及媒体负面报道等危害后果；三、在规定期限内改正的。</span></section><section style='line-height: 1.75em;margin-bottom: 15px;margin-left: 8px;margin-right: 8px;'><span style='font-size: 16px;'>据了解，本次《省免罚清单》旨在进一步规范交通运输行政处罚行为，统筹执法“力度”与“温度”。对符合条件的轻微违法行为，在依法作出不予处罚决定的同时，将按照“谁执法谁普法”的要求加强对当事人的普法宣传，并采取签订“交通运输轻微违法行为免予处罚告知承诺书”等方式教育、引导、督促其自觉守法。</span></section><section style='line-height: 1.75em;margin-bottom: 15px;margin-left: 8px;margin-right: 8px;'><span style='font-size: 16px;'>对当事人被免予处罚并作出承诺的，将通过“一体化+智慧执法+信用监管”江苏交通综合执法新模式，加强各地各部门联动，运用“互联网+”、大数据等，提高执法效率，加强信用管理和宣传，引导当事人诚实守信，自觉履行承诺。</span></section><section style='line-height: 1.75em;margin-bottom: 15px;margin-left:
