font-size: 17px; letter-spacing: 1px;'><span style='font-size: 15px;'>为贯彻落实《优化营商环境条例》《江苏省优化营商环境条例》、江苏省委省政府《关于促进民营经济高质量发展的意见》（苏发〔2019〕3号）、徐州市监察委员会、徐州市司法局《关于梳理发布第二批“涉企轻微违法行为不予行政处罚和一般违法行为从轻减轻行政处罚清单”相关工作的通知》（徐司〔2021〕92号）精神，进一步探索实施包容审慎监管，实施全市市场监管系统涉企免罚轻罚事项的清单化管理，根据《中华人民共和国行政处罚法》《国家市场监管总局关于修改<市场监督管理行政处罚程序暂行规定>等第二部分规章的决定》（国家市场监督管理总局令 第42号）等规定，市局制定实施《市场监管系统第二批涉企轻微违法行为不予行政处罚和一般违法行为从轻减轻行政处罚清单》。</span></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><br></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><span style='font-size: 15px;'>一、适用范围与条件</span></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><span style='font-size: 15px;'>全市市场监管系统第二批涉企轻微违法行为不予行政处罚和一般违法行为从轻减轻行政处罚清单适用于徐州市市场监管系统行政执法工作，法律法规规章或上级另有规定的，从其规定。市场监管不予行政处罚、依法从轻和减轻处罚事项实行清单化管理，并将根据法律法规规章立改废情况及执法实践适时调整清单。</span></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><span style='font-size: 15px;'>第二批清单自印发之日起施行。对公布以前发现的当事人违法行为，尚未作出处理决定且符合清单界定条件的，适用不予行政处罚、依法从轻和减轻处罚。</span></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><br></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><span style='font-size: 15px;'>二、免罚轻罚的后续处理</span></p><p style='vertical-align: inherit; font-size: 17px; letter-spacing: 1px;'><span style='font-size: 15px;'>对于市场主体不予行政处罚不等于免责，轻罚更不是纵容。不予行政处罚仅仅是对市场主体不给予行政处罚，并不免除市场主体停止并纠正违法行为、积极消除危害后果的整改责任。各级市场监管部门和办案机构要督促市场主体限期改正，并按照“过罚相当原则”、“教育与处罚相结合原则”主动作为，通过责令改正、批评教育、指导约谈等措施，促进市场主体依法合规开展生产经营活动。同时对发现的违法产品，应采取监督市场主体主动销毁违法产品、拆除经营设备等方式，督促市场主体做好后处理工作，防止违法产品流入市场。日常监管中要积极帮助市场主体提高经营管理水平，落实主体责任，从源头上提升监管执法效能。</span></p><p style='vertical-align: inherit;
